Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions of Sale (GTC) define the contractual rights and obligations between, on the one hand, Chouka, a brand operated by the company LOUISNARD, registered with the Trade and Companies Register of Grenoble under number 880 052 691, whose registered office is located at 97 rue Charles Michels – 38600 Fontaine – France, operating the website https://www.le-chouka.com (hereinafter “the Seller”), and on the other hand, any non-professional individual wishing to make a purchase via the website (hereinafter “the Customer”).

Any order placed on the website implies full acceptance of these Terms and Conditions.

2. Products

The products offered for sale are exclusively developed and marketed under the Chouka brand, available on the website while stocks last. Each product is presented with a description and its essential characteristics.

Photographs and illustrations are non-contractual.

Chouka reserves the right to modify its catalog at any time.

3. Prices

The prices of the products are indicated in euros (€) or in any other currency available on the website, all taxes included (VAT).

They do not include shipping costs or any taxes or customs duties for orders outside the European Union, which remain the responsibility of the Customer.

Chouka reserves the right to change its prices at any time, but the products will be invoiced based on the price in effect at the time of order confirmation.

4. Order

An order is considered final once the payment has been validated and a confirmation email has been sent by Chouka.

Chouka reserves the right to refuse any order for a legitimate reason:

  • Payment declined
  • Previous dispute with the Customer
  • Order suspected of fraud or irregularity

5. Payment

Payments are secure and can be made by:

  • Credit card (Visa, MasterCard…)
  • PayPal
  • Bank transfer

The order is shipped only after full payment has been received.

6. Delivery

Chouka delivers in France and internationally via:

  • La Poste (national or international service depending on destination)
  • Other carriers occasionally if necessary

Delivery times are indicative and may vary depending on postal services, customs, or exceptional events.

The risk of loss or damage is transferred to the Customer at the time of delivery. The Customer must check the condition of the package upon receipt.

7. Customs and international taxes

For orders outside the European Union, any customs duties, import taxes, or administrative fees are the sole responsibility of the Customer. Chouka cannot be held responsible for these additional costs.

8. Retention of ownership

Chouka retains ownership of the products until full payment of the order.

9. Right of withdrawal

In accordance with the Consumer Code, the Customer has a 14-day period from receipt of the order to exercise the right of withdrawal without justification.

Are excluded:

  • Customized products
  • Used or incomplete products
  • Opened hygiene products

Return shipping costs are the responsibility of the Customer.

10. Warranties

The products are covered only by the legal warranty of conformity and the warranty against hidden defects in accordance with Articles L217-4 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.

11. Safety and liability

Chouka products are designed for sports and leisure but are in no way safety equipment.

The use of the products is the sole responsibility of the Customer, who must comply with the safety rules related to the activity practiced (paragliding, climbing, diving, etc.).

Chouka and the company LOUISNARD decline all responsibility in the event of any accident, injury, damage, or loss resulting from the use of the products.

12. Intellectual property

All content on the website (texts, images, logos, products, Chouka brand) is protected by intellectual property law. Any reproduction without authorization is prohibited.

13. Personal data

Chouka collects customer data solely for order management and customer relations.

In accordance with the GDPR, the Customer may exercise their rights of access, rectification, and deletion via the Contact page of the website.

14. Customer service

For any questions, returns, or complaints, the Customer is invited to visit the Contact page.

15. Applicable law and disputes

These Terms and Conditions are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution before taking any legal action.
